Sales Tax Basics for Invoicing
Sales tax in the US is governed at the state and local level, which means rates, rules, and taxable items vary dramatically by location. This guide covers the fundamentals every business owner needs to know when adding tax to invoices.
Our Invoice Generator supports two tax lines (useful for combined state + county taxes), custom tax labels, and automatically calculates tax on the after-discount subtotal β the correct method in all US states.
When to Charge Sales Tax
- Physical products: Almost always taxable (with exceptions for groceries, clothing, and medicine in some states)
- Digital products: Increasingly taxable β about 30 states now tax digital goods like software, downloads, and streaming
- Professional services: Generally not taxable in most states (consulting, legal, accounting, design)
- Construction and repair: Varies widely β some states tax labor, others only tax materials
- SaaS: The fastest-evolving area of sales tax law. About 20 states currently tax SaaS subscriptions
States With No Sales Tax
Note: Alaska has no state sales tax, but some Alaska municipalities impose local sales taxes up to 7.5%. The other four states are truly tax-free.

- Always show tax as a separate line item β never bundle it into your prices
- Label the tax line clearly: βSales Tax (8.25%)β or βCA State Tax (7.25%)β
- If you have combined taxes (state + county + city), you can use either one combined line or separate lines
- Apply tax to the subtotal after any discounts β this is the standard method and what our Invoice Generator does automatically
- If you're tax-exempt or the transaction is exempt, note this on the invoice
Understanding Nexus
You're only required to collect sales tax in states where you have βnexusβ β a connection that creates a tax obligation.
Physical Nexus
Having a physical presence: an office, warehouse, employee, or inventory in the state.
Economic Nexus
Exceeding a sales threshold in the state. Most states set this at $100,000 in annual sales or 200 transactions. Since the 2018 Wayfair decision, economic nexus applies to online sellers even without physical presence.
If you're unsure about your nexus obligations, consult a tax professional. Getting it wrong can result in back taxes, penalties, and interest.
